The Provincial Court of Alicante has sentenced a barman at a Benidorm pub to six months in prison for humiliating two customers because of their sexual orientation. The court ruled that the offence was committed in violation of fundamental rights and public freedoms protected by the Constitution. He was also fined 1,080 euros.
Judges imposed a further fine of 1,080 euros for two counts of assault. The court heard that the barman insulted the men inside the venue and later attacked them as they tried to leave, punching one to the ground and headbutting the other when he intervened. Both required medical treatment.
Each victim will receive 440 euros in compensation for injuries and moral damages. The incident happened on the night of 30 October 2022 at a pub specialising in live music.
The ruling follows a plea agreement between the defendant and the public prosecutor. The sentence has been declared final and cannot be appealed.
