An administrative section of Elche’s Court of Instance has partially upheld a legal challenge by Recreativos Acuáticos Horadada against Torrevieja Council and the consortium awarded the beach concession. The concession covers sunbeds, parasols and water activities for four seasons, from 2025 to 2028, and was awarded to a consortium formed by Actividades Náuticas Torrevieja and Baliser Equipamientos de Playas.

The court found that the council’s tender panel had departed from the municipal technical report without providing sufficient reasons. That report had awarded Recreativos Acuáticos Horadada the full 16 points available for an accessibility improvement, including a 12-metre adapted walkway and a lift for people with reduced mobility.

The judge ruled that later information from the company had clarified its original offer rather than changed it. The court therefore annulled the award and the council’s rejection of the company’s initial appeal. The council must return the process to the stage before the tender panel’s decision and make a new, properly reasoned proposal.

The ruling does not make Recreativos Acuáticos Horadada the successful bidder, nor does it grant the €55,619 compensation it sought. The decision can be appealed to the High Court of Justice of the Valencian Community. The current operator may continue providing the service while any appeal is considered.
