Torrevieja Town Hall has rejected an appeal lodged by the owner of a prominent seafront restaurant after it was refused permission to install a terrace on public land. The decision confirms a 4 March 2026 decree ordering the removal of the fixed, covered and glazed structure on Calle del Mar, at its junction with the Paseo de las Rocas.

The council says the terrace breaches planning regulations and fire safety rules. Technical reports state that the structure blocks emergency vehicle access and removes the required manoeuvring space for fire engines near neighbouring buildings. Officials also argue that the installation, measuring around 94.5 square metres, lacks the necessary major works licence and cannot be legalised.

An urban planning enforcement procedure was opened in January 2026 following a complaint submitted in October 2025. The council maintains that the appeal provided no new evidence to challenge the unfavourable technical reports. It has also refused to suspend the order requiring immediate removal of the unauthorised elements.

The company can now take the matter to the administrative court in Elche within two months. Meanwhile, the structure remains in place, although the restaurant has cleared a pedestrian corridor between the façade and the terrace in line with current regulations.
